7. Brexit and the Reform of Economic and Monetary Union

Abstract

The chapter examines the legal mechanisms to reform EMU—(1) EU legislation, (2) amendments to intergovernmental treaties concluded outside EU law and (3) amendments to the EU treaties. The chapter provides guidance on how to introduce a number of needed changes to EMU, including the completion of Banking Union, the setup of a European unemployment insurance system and the creation of a fiscal capacity. As the chapter suggests, while many reforms can be accomplished à traité constant, enhancing the EU institutional systems ultimately requires changing the EU treaties: this prospect however is increasingly likely as a result of Brexit.
