Abstract

On 1 March 2005, the State council promulgated the Regulation on Collective Administration of Copyright (hereinafter the Regulation), which now governs the establishment, organizational structure, activities and supervision of Collective Management Societies (CMSs).

In general, monopoly without effective regulation causes many problems, such as price distorting (according to the European Commission, for example, the natural monopoly environment seriously distorts the price system for music) and discriminatory treatment (in light of the Chinese government’s interference, the authorized monopoly model may make both rights-holders and copyright users vulnerable), which hopefully will be avoided in the competitive model.
