Hans-Bernd Schäfer’s work is most associated with comparative law and economics, in which area he has used distinctions between civil-law and common-law jurisdictions to explore the efficiency of legal structures. In particular, he has cautioned against the wholesale transplant of legal structures and rules across jurisdictions with different histories and traditions. In this spirit, I explore below some recent themes in family law, using an Anglo-German comparison to contrast the discretionary approach of the English court, particularly in relation to family property rights, with the more formulaic approach followed in German law. I have in mind the settling of disputes between intimate cohabiters, who may be married or unmarried, and some recent suggestions in England to follow a continental example in creating obligations between unmarried cohabitants.

The welfare standard throughout the analysis is an assessment of what the parties to a dispute might be expected to have chosen, had they foreseen their eventual conflict.
