Abstract

This chapter delves into the international responsibility of States for their AI-enabled space activities, challenging the prevalent notion that new legal frameworks are urgently needed. It argues that the existing public international law, particularly the norms of State responsibility, provides a robust framework to address liability and responsibility issues arising from AI in space. The chapter recapitulates the essential arguments presented throughout the book and answers the research questions posed at the beginning. It proposes three viable solutions within the current lex lata, including amending the Liability Convention and applying general international law norms. The chapter also discusses the limitations of the fault standard under international law in the context of emerging AI technologies and suggests ways to hold States responsible for their AI-enabled space activities. It concludes that the existing legal framework is sufficient to govern responsibility and liability aspects for AI-enabled space activities, underpinning the hypothesis that the current legal regime can adequately address these novel issues.
