Abstract

This chapter delves into the evolving concept of 'appropriate and proportionate remuneration' under Art. 18 EU Directive 2019/790, particularly in the context of the data era. It explores whether data can serve as a valid form of remuneration for authors in digital copyright licensing agreements. The analysis is structured around several key topics: the contours of the principle of appropriate and proportionate remuneration, the potential of data as a non-monetary form of remuneration, and the conditions under which data could qualify as appropriate and proportionate remuneration. The chapter concludes by discussing the broader implications of data as remuneration in the digital economy, highlighting the need for additional safeguards to protect authors' interests. This comprehensive examination provides valuable insights into the future of copyright licensing in the data-driven world.
