Zusammenfassung

Das Berufsbild des Mediators ist in der Entwicklung und noch lange nicht abgeschlossen. Durch das Mediationsgesetz wurden einige grundlegende Regelungen für Mediationsverfahren und auch den Mediator festgelegt. Allerdings sind die Regelungen im Mediationsgesetz ganz überwiegend am Mediationsverfahren ausgerichtet und geben mit Blick auf eine Berufsethik nur einige Hinweise im Bereich der Neutralität und der Verschwiegenheit des Mediators. Das angemessene Verhalten des Mediators kann daher in vielen Situationen nur über das Berufsethos ermittelt werden, das sich in mittlerweile fast dreißig Jahren Mediationsentwicklung in vielen Punkten verfestigt hat.
