Abstract

The chapter delves into the crucial role of seafarers in international trade and maritime transportation, emphasizing their occupational security, which includes insurance, workplace safety, paid annual leave, and repatriation. It discusses the Maritime Labour Convention, 2006, known as the 'seafarers' bill of rights,' and how China has aligned its regulations with this international standard. The chapter also explores the practical issues faced by seafarers and employers, such as the types of seafarer claims subject to maritime liens and the model formats for seafarer employment agreements. Additionally, it provides an overview of the administration system for seafarer employment in China and highlights common disputes and their resolution through maritime courts and arbitration. The chapter concludes with a discussion on the implementation of the Maritime Labour Convention, 2006, in China and the jurisdiction of maritime courts in seafarer-related disputes.
