Zusammenfassung

Das Recht hinkt der Technik oft hinterher, egal ob es sich um verbindliches (hard-law) oder unverbindliches Recht (soft-law) handelt. Nicht nur die EU stellt daher auf Digitalisierung (insb. künstliche Intelligenz, Robotik) ab, die den Anforderungen der Ethik, der Werte und der Menschenrechte entspricht. Werte und Menschenrechte stellen dabei eine Brücke zwischen dem Recht und der Ethik dar. Im Bereich der Ethik kann neben den bekannten normativen Theorien (Deontologie, Konsequentialismus, Tugendethik) insb. auf ethische Prinzipien (Autonomie, Fürsorge, Gerechtigkeit und Schadensminderung) abgestellt werden, die sich bereits in anderen Bereichen bewährt haben. Darüber hinaus spielen die folgenden ethischen (und zum Teil auch rechtlichen) Prinzipien eine bedeutende Rolle: Transparenz, Fairness, Verantwortung, Privatsphäre, Freiheit und Nachhaltigkeit. Es sollte nicht nur im Interesse der Gesellschaft, sondern auch der Digitalwirtschaft sein, diesen Anforderungen zu genügen.
