Abstract

This chapter delves into the critical role of regulatory cooperation in enhancing market integration and economic growth within the African Continental Free Trade Area (AfCFTA). It explores the importance of aligning regulatory frameworks across the 55 member states to foster intra-African trade and development. The chapter highlights the challenges posed by differing regulatory philosophies, economic disparities, and inadequate infrastructure, and proposes collaborative dispute resolution mechanisms and phased regulatory approaches to overcome these obstacles. Additionally, it underscores the significance of proactive collaboration, information sharing, and ongoing dialogue to maximize the benefits of the AfCFTA for all stakeholders. The chapter also examines the historical context of the AfCFTA, influenced by the Lagos Plan of Action and the Abuja Treaty, and compares it with successful regional trade agreements in Asia. It addresses the need for harmonized standards to minimize confusion and costs associated with testing procedures, and the importance of streamlining regulatory standards to reduce complexity and redundancy. The chapter also discusses the role of regulatory cooperation in promoting the active participation of marginalized groups, such as women and informal traders, in the formal trade sector. It highlights the potential of e-commerce and cross-border data flows in enhancing regional trade, and the need for regulatory cooperation to address data sovereignty issues. The chapter concludes with a call for strengthened information sharing arrangements, effective dispute resolution mechanisms, and the alignment of domestic policies with regional and international regulatory goals to ensure the effectiveness and robustness of regulatory cooperation in the AfCFTA.
