Das Amt des Menschenrechtskommissars des Europarats (nachfolgend: Menschenrechtskommissar) geht auf einen Beschluss des zweiten Europaratsgipfels von 1997 zurück. Im Aktionsplan des Gipfeltreffens begrüßten
„the Heads of State and Government (...) the proposal to create an office of Commissioner for Human Rights to promote respect for human rights in the member States and instruct the Committee of Ministers to study arrangements for its implementation, while respecting the competences of the single Court [des EGMR; KB].“

Nach rund zweijährigen Vorarbeiten wurde die Stelle des Menschenrechtskommissars im Mai 1999 im Zuge der Feierlichkeiten zum 50-jährigen Bestehen des Europarats durch eine Resolution des Ministerkomitees geschaffen.
