Abstract

This chapter delves into the application of behavioral economics in criminal law, focusing on the concept of 'nudges' to influence criminal behavior. It begins by examining the theoretical foundations of behavioral analysis of law (BAL) and its potential to reshape criminal policy. The text then addresses the challenges posed by Harel and Teichmann, including the inconsistency of BAL with traditional criminal law theories, the indeterminacy of BAL's predictive force, and the alignment of BAL with non-consequentialist intuitions. The chapter provides a detailed analysis of the methodological and normative problems associated with criminal nudging, offering solutions to overcome these issues. It also explores the ethical implications of using nudges in criminal policy, emphasizing the importance of justifying policy actions that maximize individual freedom within a coercive system. The chapter concludes by highlighting the potential of behavioral insights to enhance the effectiveness of criminal law while respecting the principles of the rule of law. Readers will gain a deeper understanding of the intersection of behavioral economics and criminal law, the challenges and opportunities of using nudges in criminal policy, and the ethical considerations that must be taken into account.
