Abstract

The chapter delves into the legal and human rights implications of the Greece/Turkey border events in 2020, focusing on the responsibilities of Greece and Turkey under the European Court of Human Rights (ECtHR). It provides a detailed overview of the events, including the use of excessive force by Greek authorities and the facilitation of refugee movement by Turkey. The chapter analyzes specific human rights concerns, such as the principle of non-refoulement and access to protection procedures, and discusses the challenges the ECtHR may face in ruling on pushback cases. It also explores the potential use of circumstantial evidence and the reversal of the burden of proof in cases involving secret migration detention. The chapter concludes with an analysis of the overall human rights responsibilities of Greece and Turkey and the future role of the ECtHR in resolving such cases.
