Abstract

This chapter examines the transformation of Tunisian family law from a pluralistic system to a unified Code du statut personnel (CSP) in 1956. It discusses the historical context of legal pluralism under colonial rule, the post-independence reforms aimed at creating a national identity, and the challenges in balancing religious diversity with legal unification. The text highlights the symbolic measures of the CSP, such as the abolition of polygamy and the establishment of a monogamous, egalitarian marriage model. It also explores the contemporary debates and jurisprudence surrounding the interpretation of the CSP, particularly the tension between Islamic and secular interpretations. The chapter concludes by discussing the future prospects for legal reforms and the recognition of diverse family models in Tunisia.
