Abstract

Um ein Schuldverhältnis durch ein Rechtsgeschäft begründen zu können, ist grundsätzlich ein Vertrag erforderlich. Bei einem Vertrag handelt es sich um ein Rechtsgeschäft. Es kommt zustande, wenn übereinstimmende Willenserklärungen von mindestens zwei Personen vorliegen, ein Antrag (§ 145 BGB) und seine Annahme (§ 147 BGB).
