Abstract

This chapter delves into the EU's regulatory approaches to algorithmic management of work, focusing on the Platform Work Directive (PWD) and the AI Act. It begins by demystifying the concept of algorithmic management, which involves the use of automated systems to replace traditional managerial functions. The text highlights the lack of a clear legal definition of algorithmic management at the EU level and explores the definitions provided by international literature. It then compares the rights-based approach of the PWD with the risk-based approach of the AI Act, highlighting the strengths and weaknesses of each. The PWD is praised for its comprehensive protection of platform workers' rights, including transparency, human oversight, and the right to explanation and review of automated decisions. In contrast, the AI Act is criticized for its focus on risk assessment and self-regulation, which may not adequately protect workers' fundamental rights. The text also discusses the potential risks of algorithmic management, such as opacity, bias, and the erosion of workers' autonomy. It concludes by arguing for a more robust regulatory framework that prioritizes workers' rights and ensures that algorithmic management is used in a fair and transparent manner.
