Abstract

The chapter delves into the historical Eurocentrism of international law and the need to incorporate Islamic legal scholarship, particularly in the context of the International Criminal Court (ICC). It examines the proposition of including an Islamic law scholar as an ICC judge and the challenges and prospects of such integration. The research conducts a detailed comparative analysis between Islamic law and international criminal law, focusing on war crimes against civilians. It groups these crimes into four types and explores how traditional Islamic legal scholarship views and regulates them. The study also discusses the principles of Islamic law, such as legality, non-retroactivity, and the presumption of innocence, and their compatibility with ICC principles. Additionally, it examines the concept of ta’zir in Islamic law and its potential alignment with international law based on the principle of maṣlaḥat. The chapter concludes by highlighting the areas of compatibility and the challenges that remain in bridging the gap between Islamic law and international criminal law.
