Abstract

The chapter delves into the International Criminal Court’s (ICC) significant role in addressing reproductive justice, particularly through the groundbreaking Ongwen case which recognized forced pregnancy as a crime against humanity. It traces the historical evolution of reproductive violence in international law and the contentious negotiations that led to the inclusion of forced pregnancy in the ICC Statute. The analysis highlights the ICC’s potential to influence domestic legal frameworks through its jurisprudence and the principle of positive complementarity. The chapter also discusses the challenges and limitations in the current definition of forced pregnancy and the need for a more progressive interpretation. It concludes by emphasizing the ICC’s potential to transform patriarchal narratives and promote reproductive autonomy and justice.
