Abstract

The article explores the critical role of energy efficiency in the EU's sustainability goals, as outlined in the 'Fit for 55' package, which aims to transform the European economy and reduce energy consumption. It highlights the Energy Efficiency Directive (EED) and its promotion of energy performance contracting (EPC) as a key strategy for achieving energy savings in both existing and new infrastructure. The EED emphasizes the 'Energy Efficiency First' principle, which ensures that only necessary energy is produced and that investments in stranded assets are avoided. The article delves into the complexities of guaranteed energy savings in EPC models, where Energy Service Companies (ESCOs) are responsible for energy retrofits, financing, and guaranteeing energy savings. It examines the regulatory frameworks in the EU and Poland, including the EED, Eurostat guidelines, and Polish national legislation, to understand the allocation of risks in EPCs. The analysis reveals that while the EED provides a flexible approach to EPCs, the Polish regulations introduce specific provisions that affect the classification of EPC contracts as public debt. The article also discusses the challenges and opportunities associated with EPCs, including the need for clear guidelines, the importance of stakeholder cooperation, and the potential for discrepancies in debt calculations. Through in-depth interviews with stakeholders, the article provides valuable insights into the practical implementation of EPCs and the risks involved in guaranteed energy savings. It concludes by highlighting the need for further research and the importance of addressing the core issues related to the risk of guaranteed energy savings in EPC projects.
