Abstract

The right to work is always a pressing issue of paramount importance to ensure sustainable development. For disabled workers, the right to work aims to secure employment and promote their social integration. Through analysis and evaluation, this paper elucidates the working aspect of disabled individuals under Vietnamese law to provide a comprehensive and objective assessment of the regulations and the assurance of this right in Vietnam.

The International Labour Organization defines forced labor as “all work or service which is exacted from any person under the menace of any penalty and for which the person has not offered themselves voluntarily.” Member States are required to eliminate, prohibit, and combat all forms of forced labor as stipulated in Article 4 of the Universal Declaration of Human Rights, Article 5 of the Slavery Convention, and Article 8 of the ICCPR.

Article 4 of ILO Convention No. 158 (1982) concerning Termination of Employment defines the legality of terminating an employment relationship and imposes the requirement to provide valid grounds for termination, as well as legal rights and other remedies in cases of unlawful termination of the employment relationship.

According to Clause 4, Article 8 of Circular 78/2014/TT-BTC, tax-exempt income includes “Income from the production and business activities of enterprises where the average number of employees who are persons with disabilities, persons who have completed drug rehabilitation, or persons living with HIV constitutes 30% or more of the enterprise’s average total workforce for the year”.

According to Point đ, Clause 1, Article 9 of Decree 28/2012/ND-CP: Exemption from land rent, premises rent, and water surface rent for production and business facilities that employ 70% or more of their workforce as persons with disabilities. A 50% reduction in land rent, premises rent, and water surface rent is provided for production and business facilities that employ between 30% and under 70% of their workforce as persons with disabilities.
