5. Origins and Consequences of American Multicultural Federalism: Constitutional Patriotism, Territorial Neutrality, and National Polarization

Abstract

This chapter explores the key counter-example in the study of multinational federalism and explains why the United States became a multicultural federation. It argues that, in deciding not to impose culturally homogenizing policies on a heterogeneous society, the founders opted to foster national unity around the Constitution thus allowing expressions of cultural preferences to differ across constituent territories. Consequently, American multicultural federalism is a ‘double-edged sword.’ On one edge, federal tolerance of territorial and non-territorial expressions of diverse cultural preferences has fostered national unity. On the other edge, some of the most ardent expressions of such preferences, especially those pivoting on racism, have provoked moral approbation that has generated calls for federal intervention that, in turn, have triggered national polarization.

This chapter uses the terms multicultural and multiculturalism in a broad sense, that is, in reference to a diversity of cultural preferences that may or may not find territorial expressions and may or may not be the result of a specific political project as understood in some of the literature (e.g., Kymlicka 1995).

The Constitution also places insignificant limits on states’ tax powers. States enact income, sales, property, and many other taxes and fees. They have broad leeway to use taxes to regulate behaviour. No federal constitutional limits inhibit state borrowing. Consequently, state and local citizens have wide fiscal and police powers to enact and finance their political, socioeconomic, and cultural preferences.

These laws have been passed with a number of specific justifications. For example, the California Official English law was framed as a response to the institutionalization of ‘cultural pluralism’ (Tatalovich 1995, p. 119), while the Colorado law was articulated as a means to prevent the creation of parallel English-speaking and Spanish-speaking communities (p. 155). Official English laws in Idaho, Iowa, and Missouri were defined by their main proponents as instruments of immigrant integration (Tremblay 2019, p. 179).
