Abstract

Why do aggrieved member countries choose not to litigate within the WTO’s Dispute Settlement Body (DSB)? This is a very important and timely question that this chapter lays the foundation for answering. It argues that “non-participatory membership” is manifested as those situations in which a country has a reason to be either a complainant or respondent in a trade dispute and opts not to do so for a variety of reasons. This can occur as pure non-participation, strategic bargaining and free riding. The chapter outlines six major explanations for this choice by states and argues that all trading dyads make these considerations. To probe this phenomenon in a way that adds to the broader literature, it makes the case for a mixed methods study comprising formal models, case studies and the information theory approach.
