Abstract

Decentralization is a demonstration of balance of power. Therefore, when central governments do not make a conscious decision to decentralize, their decisions and actions increasingly make local governments powerless (Awortwi, International Review of Administrative Sciences, 77(2) 347–377, 2011). Over the period, there have been many reform processes which have targeted the administrative, political and fiscal components of local governance in Ghana. The most ambitious and politically daring reform proposal of the system by the central government has been the election of Chief Executives as political heads of local government units. This chapter asks; would the election of Chief Executives at the subnational scale improve local governance in Ghana?

The longest serving Local Government Minister from 1993 to 2000, and prior to that the head of the Central Government tasked force which established local government in Ghana in 1988.

Article 243 authorises the president to nominate for approval by the local assembly a person to be appointed as Chief Executive for each local government district. However, with the president’s power to appoint 30% of members of the local assembly whom he can remove at without recourse to any provision, many of the nominees of the central government receive automatic approval from the Assembly.

Some defeated parliamentary candidates have been appointed.

District as used in the Constitution of Ghana includes Municipal Assemblies and Metropolitan Assemblies.

Elections for the district assembly was non-partisan which meant no stakeholder be it Civil Society Organisation or political party could support a candidate. With the amendment, CSOs could assist a candidate in the campaign process. The system still remained a non-partisan though.

The LI 1961 saw the transfer of civil servants working at the local level to be part of the Local Government Service and thereby constituting a local bureaucracy to help implement the devolved functions of the local governments.

LGS is responsible for recruitment, training, transfers and all other Human Resources activities of the local government.

The District Assembly Common Fund (DACF) is a constitutional creation which stipulates that at least 5% of GDP must be shared among all local governments. The Constitution established an independent administrator who works with parliament on a formula for disbursement.

Every year the ministry of Local Government and Rural Development conduct assessment of all assemblies. Successful assemblies are rewarded with financial resource which was to be used to provide community infrastructural facilities.
