Fit for 55”: The EU Plan for a Green Transition

Abstract

This article focuses on the importance of the “fit for 55” legislative package, which has as its main objective the transformation of the economy, society, and industry towards climate neutrality. Fit for 55 aims to ensure that the European Union meets the target of a 55% reduction in net greenhouse gas emissions by 2030 compared to 1990. There are several legislative proposals with regulations for areas as diverse as climate, energy and fuels, transport, buildings, land use, forests, or taxation. The legislation is presented as a comprehensive package, but will this package remain intact? Obviously, there are major political and legal challenges ahead. These various measures are positioned as inter-related and inter-dependent. They reflect a chosen policy mix of legal instruments that in turn represents a careful balance between pricing, targets, standards, and support measures. In this paper a critical analysis will be made of some of the main legislative proposals that are included in the “fit for 55” package, namely: (i) Reform of the Emissions Trading System; (ii) Effort Sharing Regulation (ESR); (iii) Revision of the Regulation on the inclusion of greenhouse gas emissions and resulting from activities related to land use, land use change and forestry (LULUCF); (iv) Revision of the Directive on the implementation of alternative fuels infrastructure; (v) Revision of the Regulation setting CO2 emission performance standards for new passenger cars and new light commercial vehicles.

In order to accurately account for emissions and removals in accordance with the 2006 Intergovernmental Panel on Climate Change (IPCC) guidelines (IPCC guidelines), the values reported annually under Regulation (EU) No 525/2013 of the European Parliament and of the Council for land use categories and conversion between land use categories should be used. This should thereby simplify the approaches used under the UNFCCC and the Kyoto Protocol. Land that is converted into another land use category should be considered to be in transition to that category for a period of 20 years, which is the default value defined in the IPCC guidelines. Member States will be able to derogate from this default value only when dealing with forested land and only in very limited circumstances that are justified by virtue of the IPCC guidelines. Amendments to the IPCC guidelines adopted by the Conference of the Parties to the UNFCCC or by the Conference of the Parties serving as the Meeting of the Parties to the Paris Agreement should be reflected, as appropriate, in the reporting requirements under this regulation.

Removals resulting from managed forest soils should be deducted from the projected forest reference level. Projected future removals by sinks should be based on an extrapolation of forest management practices and intensity from a reference period. A decrease of a sink relative to the reference level should be accounted for as emissions. The specificity of the national situation and practices such as, for example, lower than usual felling intensity or ageing of forests in the reference period, should be taken into account.

The CO2 emission standards that promote the availability of new zero-emission vehicles on the market are also a complementary measure to Directive (EU) 2018/2001 on energy from renewable sources.

Finally, while CO2 emission standards guarantee the supply of zero-emission vehicles, Directive 2014/94/EU on the alternative fuels infrastructure that encourages the deployment of charging and refueling infrastructure is a necessary complementary instrument to remove the market barrier to the creation of such infrastructure.
