Abstract

Nahezu jedes Bauprojekt ist von Streitigkeiten unterschiedlicher Formen geprägt. Die Ursachen dieser Konflikte beruhen in den meisten Fällen auf zwei Säulen: Eine ungünstige Ausgangslage mit einer daran anknüpfenden unsachgemäßen Kommunikation. Beide Aspekte sind ummantelt von der schon vor Vertragsschluss herrschenden Vorstellung der Vertragsparteien, ihre jeweils im Gesetz vorgesehenen Rechtspositionen bestmöglich absichern zu wollen.
