Zusammenfassung

Rücktritte aus dem amerikanischen Repräsentantenhaus stellen seit einem halben Jahrhundert den Großteil der dortigen Fluktuation dar. Neben einer Vielzahl von Faktoren, die traditionell Rückzüge mitbestimmen, ist nunmehr die größere Relevanz nationaler politischer Trends ebenso von Bedeutung. Diese erschweren es Kongressabgeordneten eine eigenständige und unabhängige Reputation aufzubauen und binden ihre politische Zukunft an die Popularität der nationalen Partei. Im Obersten Gericht kann der Zeitpunkt von Rücktritten die ideologische Ausrichtung der Institution für Jahrzehnte prägen. Will ein scheidender Richter seine Rechtsphilosophie wahren, muss er den rechten Zeitpunkt für den Abtritt abpassen. In beiden Organen beeinflusst schlussendlich die wachsende Polarisierung des Landes auch die Entscheidung, von einem Amt zurückzutreten.

Dies bezieht sich auf Wahlkreise, die entsprechend der Analyse des Cook Political Report (vgl. Wasserman 2022) entweder drei Prozentpunkte republikanischer oder demokratischer als das Land bezüglich ihrer parteipolitischen Präferenzen allgemein sind.

Um die Debatte zu einem bestimmten legislativen Vorstoß zu beenden („Cloture“), bedarf es im Senat einer 3/5-Mehrheit. Somit kann auch eine vergleichsweise kleine Minderheit politischen Forderungen Gehör verschaffen.

Fred Vinson (1953), William Rehnquist (2005), Antonin Scalia (2016) und Ruth Bader Ginsburg (2020).

1805 stimmte das Repräsentantenhaus für die Aufnahme der Anklage gegen Samuel Chase, der jedoch vom Senat freigesprochen wurde. Abe Fortas, konfrontiert mit einem potenziell aussichtsreichen Amtsenthebungsverfahren, entschied sich 1969 für seinen Rücktritt (vgl. Epstein et al. 2021, S. 434).

Zahlreiche Abgeordnete der unteren Kongresskammer hatten hierbei ihre Konten bei der Hausbank des Repräsentantenhauses ohne Strafe überzogen.
