Zusammenfassung

Warum nutzt die EU den Handlungsdruck, der von der Krise ihres dysfunktionalen Asylsystems ausgeht, nicht als Gelegenheitsfenster für innovative Reformen? Im analytischen Bezugsrahmen der Spieltheorie und auf der Grundlage der empirische Policyanalyse von Konfliktkonstellationen in der internen Dimension der EU Asylkrise wird argumentiert: Politische Innovationen scheitern an den Interessenskonflikten und Machtunterschieden der Mitgliedstaaten. Mittelbar spielen dafür auch die Akzeptanz- und Legitimationsprobleme innovativer Lösungen zugunsten der Harmonisierung und fairen Verteilung der Verantwortung für die Aufnahme von Geflüchteten eine Rolle, die im Zuge des Erstarkens nationalistischer und rechtspopulistischer Einstellungen bei Teilen der Wähler*innen gegenüber den Regierungen signalisiert werden.

Der Begriff „Flüchtlingskrise“ legt nahe, dass eine nie dagewesene Zahl an Flüchtlingen in Europa zu einer Krisensituation geführt habe. Zwar hat Europa in den Jahren 2015 und 2016 die höchste Zahl von Flüchtlingen seit dem Zweiten Weltkrieg aufgenommen (Niemann und Zaun 2018, S. 3), allerdings kann man davon ausgehen, dass eine Region mit rund 500 Mio. Einwohnern durchaus in der Lage sein sollte, 1 Mio. Flüchtlinge aufzunehmen, ohne dass dies eine Krise hervorruft.

Natürlich lässt sich fragen, inwiefern es sich bei der Einführung der Europäischen Küsten- und Grenzschutzagentur oder der EU-Türkei-Erklärung um eine ‘positive‘ Neuerung handelt. Hier wird der Begriff ‘Innovation‘ wertneutral verwendet. Als Innovation wird daher jedes Instrument gewertet, das neue Politikideen einbringt, ganz gleich, ob diese positiv oder kritisch zu bewerten sind.

Ein weiterer Teil der distributiven Asylpolitik ist der EU-Flüchtlingsfonds oder der Asyl-, Migrations- und Integrationsfonds. Allerdings kann gefragt werden, inwiefern es sich hierbei wirklich um eine effektive redistributive Politik handelt bzw. ob Finanzleistungen, die Aufnahmeländer erhalten, insbesondere in der Höhe, in der diese vergeben werden, wirklich alle Kosten (inkl. die sozialen und elektoralen Kosten) abdecken.

Die meisten Mitgliedstaaten wenden einen Mix aus liberalen und restriktiven Praktiken an. Daher ist es auch schwer von grundsätzlich liberalen oder restriktiven Ländern zu sprechen. Staaten sind vielmehr restriktiv oder liberal im Hinblick auf jeweils bestimmte Merkmale. Starkregulierer können dabei sowohl restriktive als auch liberale Politiken verfolgen. Schwachregulierer bieten oftmals nur arbiträr rudimentären Schutz.

Hierbei handelt es sich um einen Idealtypus, da alle Staaten zumindest eine geringe Anzahl an Asylbewerber*innen erhalten. Als Nichtaufnahmestaaten sollen hier auch solche gelten, die vergleichsweise geringe Zahlen erhalten.

Als Verantwortungsteilung (‚Responsibility-Sharing‘) bezeichnet man die Unterstützung eines Staates, der viele Flüchtlinge erhält durch einen anderen Staat, der entweder weniger Flüchtlinge aufgenommen hat oder z. B. aus finanziellen Gründen besser dazu in der Lage ist. Diese Unterstützung kann entweder finanziell oder durch die direkte Übernahme von Flüchtlingen geschehen (Betts et al. 2017, S. 22).
