Abstract

The principle of “sincere cooperation” is stated in the EEA Agreement in the same terms as in the Treaty on the European Union, but the principle has developed in the case law of the EFTA Court so as to be even more important than in the EU. This is because the principle has been used to resolve some important ambiguities in the EEA Agreement.

Ryanair Holdings v. Competition and Market Authority, [2015] EWCA Civ 83. The Court of Appeal noted that the Competition Appeal Tribunal had accepted that it would be harder and potentially more expensive for a bid to succeed if Ryanair’s minority stake had been reduced in the meantime to 5%. The Tribunal rejected the argument that it was an EU objective that the bid should not be hampered or made more difficult by the actions of the competition authority.
