Abstract

The paper concentrates on the evaluation of American and European Union approach towards environmental liability. The latter’s evolution on both continents brings the question about the optimal standard of liability. The major contribution of this paper consists in the application of some concepts and tools developed within the field of behavioural L&E, such as availability heuristic and prospective theory within the context of environmental law (both American and European). In particular the question whether the American and European courts improved the efficiency substantially altering the standards of existing environmental liability is addressed. In the paper the evaluation of both regulations and case law is being analysed from the perspective of behavioural L&E.
