Do government sponsored marriage promotion policies place undue pressure on individual rights?

Abstract

The dominance of social science research in the debate over the Bush Administration’s Healthy Marriage Initiative may explain why questions regarding the proper role of government in regulating adult intimacy have received little attention. Social science research focuses on outcomes such as well-being and health. In contrast, rights-based legal theory considers whether state action undermines the rights of individuals. In this article, I intend to shift the debate over marriage promotion policy from questions of child well-being to questions of individual rights. I will ask the following questions: Do individuals have a liberty interest in making their own choices about intimate relationships, such as marriage? Do federally-financed (and frequently state-run) marriage programs compromise this liberty interest? Are there any constitutional grounds for objecting to marriage promotion policy?

The Marriage Movement is composed of a wide array of scholars, think tanks, social service professionals and faith-based groups. Some of the leading organizations are: the Alliance for Marriage; the Coalition for Marriage, Family, and Couples Education; Marriage Savers; and the National Marriage Project.

Republicans and Democrats disagreed primarily over what could count as a work activity and work requirements, not funding for marriage programs (Schott 2002).

While marriage promotion policy is a product of the Bush Administration, some prominent supporters of the Marriage Movement are associated with the Democratic Party. Political philosopher William Galston held the position of assistant domestic policy advisor in the Clinton Administration and Barbara Dafoe Whitehead, the author of the Atlantic article, “Dan Quayle Was Right,” has served as an advisor to the Democratic Leadership Council.

According to the Census Bureau, 32% of all births were to unmarried women in 2004 (Dye 2004). In 1950, one in three marriages ended in divorce; today, one in two marriages end in divorce (Cherlin 2003).

The purposes of TANF legislation are: (1) provide assistance to needy families so that children may be cared for in their own homes; (2) end the dependence of needy parents on government benefits by promoting job preparation, work and marriage; (3) prevent and reduce the incidence of out of wedlock pregnancies and establish numerical goals for preventing and reducing the incidence of these pregnancies; and (4) encourage the formation and maintenance of two-parent families. The other 5 activities are: education in high schools on the value of marriage, relationship skills, and budgeting; pre-marital education and marriage skills training for engaged couples and for couples or persons interested in marriage; marriage enhancement and marriage skills training programs for married couples; divorce reduction programs that teach relationship skills; and programs to reduce the disincentives to marriage in means-tested aid programs if offered in conjunction with any of the other seven activities.

McLanahan and Sandefur claim that the remaining negative effects are due to lack of parental supervision and the decreased social connections available to children growing up with one parent as opposed to two.

Moreover, as Dworkin (1977) makes clear in “What Rights Do We Have?,” there is no right to liberty, as such, but only to certain fundamental rights, such as freedom of speech.
