In Germany market-based instruments for water resources management like the Federal waste water charge and the water extraction charges of the Federal states are well established. The EU Water Framework Directive, in particular the mandate codified in Article 9 to take into account a recovery of costs for water services including environmental and resource costs requires an adequate contribution of the different water uses to the recovery of the costs of water services. Thus, additional charges for other water services have to be considered in order to fulfil the framework’s objectives in an efficient way. This article analyses possible water charges for hydro power from an economic and also a legal point of view. It can be shown that charges do not always appear to be a superior instrumental solution especially when taking into account conflicts with climate protection policies procured by the German feed-in tariffs for renewable hydro energy (German Renewable Energy Law).
