On August 19th, 1684, a certain James Nicol, merchant burgess of Peeble, stood before the Privy Council for the second day of his interrogation in Edinburgh. Mr. Nicol had been detained four days before, accused of having called to the hangman during an execution, which he deemed unjust, that he “would do him a mischief” (Christ and Thompson 1871, p. 387) “Where had he [Mr. Nicol] been the night of the execution and the night previous,” wanted to know his questioners. “I was not in town, I came in at the gate, just as the first [of the executed] was cast over,” was his response (Christ and Thompson 1871, p. 393). Such was his alibi, that if he had just come in at the gate in that moment, he could not have been yelling imprecations to the executioner at the Grass Market, where the hangings took place. …
