Abstract

This Chapter deals with the influence of Human Rights and Fundamental Rights in Portuguese Private Law. Human Rights are of utmost importance in Portuguese law and they are to be found in the Constitution of 1976 as well as in European and International texts. Human Rights have played a major role in different areas of private law. We have analysed its influence in contract law, tort law, property law, family law and intellectual property law. Portuguese Law follows the monistic paradigm and a correct interpretation of private law must include the catalogue of fundamental rights of our Constitution as well as the case law of the European Court of Human Rights.

The main differences between contractual liability and non-contractual liability in Portuguese law are the following: (1) 1he debtor is presumed to have acted in fault in case of non-performance or defective performance of a contractual duty (Article 799 (1)); (2) Limitation period in tort law is 3 years (Article 497) and 20 years in contract (Article 309). The cumul of contractual and extra-contractual liability (“Anspruchsnormen-konkurrenz”) is accepted by literature and case law, and plays an important role in cases of medical liability and transport liability. Case law accepts that non-pecuniary damages may be compensated under contract law.

Article 829-A regulates a private pecuniary sanction for every day or every event the tortfeasor breaches his duties. This is similar to the French ‘Astreinte’ and it can be very important for avoiding continuous violation of personality rights.

De facto union or unmarried partnership is only protected by law after the existence of a relationship akin to marriage which has subsisted for two years and the legal protection is still different from marriage, especially since there are no inheritance rights, no personal duties and no system of acquisition of goods and liability for debts. There is no registration on the process. Rights can be claimed after a couple lives together for two years. An application of joint tax assessment can be made to prove the union but it is not required.

Similarly the Charter of Fundamental Rights of the European Union also declares the “rights to marry and the right to found a family”. As the Constitutional Court observed, this formulation is generally interpreted as protecting both marriage and other forms of relationship (vg, de facto cohabitation).

A different Act, Law 6/2001, 11 May, protects – although with fewer legal effects – those people who share a home and a domestic economy but do not necessarily have sexual relations: mere friends or homosexuals who do not wish to overtly publicise their relation.

Portugal has ratified Protocol No. 12 to the European Convention on Human Rights and the Framework Convention for the Protection of National Minorities by Decree of 25 June 2001 and the European Charter for the Protection of Regional and Minority Languages.
