4. Legal Capacity and Non-participatory Membership

Abstract

In this chapter, the information theory approach is used to make a quantitative assessment of the four case studies and DSB litigation. The chapter examines in a new way, how variations in legal capacity affect a country’s decision to initiate or respond to a dispute at the WTO. To do this, it builds on existing definitions of legal capacity, but adds measures such as membership in WTO negotiation groups and other dispute settlement organizations, and experience at the DSB as a complainant, respondent or third party. It also evaluates experience with the Anti-Dumping Agreement domestically and at the WTO. As a test of how ready the aggrieved countries were to complain or defend their cases, legal capacity is measured only up to the time of their disputes. These factors are then comparatively assessed to show their magnitude and relationship with participation/non-participation at the DSB.
