10. Self-Representation and the Courts: Some Policy Observations from the Netherlands

Abstract

Self-representation in the courts could be seen as a means to improve access to justice. It saves the litigants the cost of a lawyer. These costs have been reported to be the biggest financial obstacle for parties with a dispute. This contribution based on the panel discussion on the topic of self-representation identifies some questions regarding self-representation from a Dutch policy maker’s perspective. These questions relate among others to the increasing complexity of society, the role of the courts and the judges in a civil procedure, the financing of the court system, legal aid and the role of oral presentations as a key element of self-representation in relation to IT-based proceedings. The conclusion is that we would need answers to these questions before we decide on a policy on self-representation in our courts.

The cantonal judge falls under the Dutch court of first instance. It deals with cases with a maximum of € 25,000 and with all cases relating to labour law, landlord-tenant case and most consumer cases (article 93 Dutch Code of Civil Procedure). The procedure before the cantonal judge is a single-judge procedure (article 47 of the Law on the Judiciary (Wet op de Rechterlijke Organisatie).
